Obtaining a Building Energy Rating (BER) certificate will ensure that you are fully compliant with the 2006 Energy Performance Buildings Directive. Failure to comply with this directive could result in substantial fines of up to €5,000 and may hinder or delay the legal completion of the sale or letting of your property.

- Provisional BER certificate
Required for All Dwellings sold off the plans and valid for two years. A BER certificate must replace the provisional certificate before the property is occupied.
- BER certificate
Required prior to occupying a new dwelling and valid for 10 years.
The owner/developer of the new dwelling will engage a registered BER assessor listed on the Register of BER Assessors to carry out the BER based on the plans and specifications for the building. All BER Assessors will be required to follow a standardized procedure using an approved calculation methodology and to adhere to a standard code of practice.

The revised building regulations (24th January 2008) introduce mandatory Air Tightness Testing for All Dwellings. All new single dwellings will require an Air Tightness Test from 1st July 2008. In the case of a development the following guidelines apply:
- Number of pressure tests required per dwelling type.
- Number of units number of tests required.
- 1-4 one test.
- 5-40 two tests.
- 41-100 5% of dwelling type.
- 101+ (if target is reached) 2%.
- 101+ (if target is not reached) 5%.
